Option contract (offer) of the «GYMWARS» online shop concerning sale of goods

1.       Definitions

1.1 The following definitions have the following meanings and are the integral part of the present option contract if not stated otherwise:

• Seller — Independent entrepreneur Sheveleva Ksenia Vladimirovna (Legal address: 690013, Russia, Vladivostok city, Admirala Kuznetsova st. 90, 229, BSRNIE 314253608400011; email: gymwars.wear@gmail.com).
• Purchaser — any physical entity that accepted the option contract on the terms of the present option contract.
• Online shop — an official online shop of the «GYMWARS» located at http://www.gymwars.pro. Under the present contract such terms like online shop and shop as well as website http://www.gymwars.pro and derivatives of gymwars.pro are of equal value and are interpreted authentically according to the option contract context.
• Goods — an object of agreement of the parties, a list of assortment items represented in the official online shop.
• Rules of sales – rules of sale of goods in the «GYMWARS» online shop published in the section  «Service and help», item “Rules of sales”

2.      General conditions

2.1    The present option contract (hereinafter – the Agreement) is an official offer of the independent entrepreneur Sheveleva K.V. to any physical entity eligible and having an authority to conclude purchase and sale contract with the independent entrepreneur Sheveleva K.V. under the terms and conditions set in the present option contract containing all the significant conditions of the agreement.

2.2    Relations in the sphere of protection of consumer rights are regulated by the Civil code of the Russian Federation, the Law “Concerning the protection of consumer rights” and accepted in accordance it other federal laws and legal acts of the Russian Federation.

3.     Registry on the website

3.1    Only registered Purchasers can make orders in the online shop and a Purchaser can register on the website only once, which means that he can have only one user account.

3.2    The Seller is not responsible for accuracy and correctness of the information provided by the Seller during registration.

3.3   Seller registered in the online shop gets an individual identification by presenting username and password. Individual identification of the Purchaser helps escape unauthorized operations by the third parties on behalf of the Purchaser and opens an access to additional services. It is forbidden for a Purchaser to pass his username and password to the third parties.

3.4    The Seller is personally responsible for all possible negative consequences in case when his username and login is passed to the third parties.

4.      Subject of the Agreement and cost of the Goods

4.1   The Seller transfers and the Purchaser accept and pay the goods under the terms of the present Agreement.

4.2    Right of ownership for the Ordered Goods is transferred to the Purchaser at the moment of the actual delivery of the Goods to the Purchaser and payment of full price of the Goods. The risk of an occasional destruction or damage of the Goods is transferred to the Purchaser at the moment of the actual delivery of the Goods to the Purchaser.

Costs of the Goods are determined by the Seller in a unilateral and indisputable manner and are stated on the pages of the online shop located at http://www.gymwars.pro.
